The terms and conditions below apply to the services available from electricalstock.com.

All electricalstock.com's members must read and accept all of the terms and conditions. The User Agreement constitutes a legally binding agreement between you and electricalstock.com.

Using electricalstock.com

The use of electricalstock.com services is on prohibited for persons over the age of 18. If you are under the age of 18 you are not able to form legally binding contracts.

electricalstock.com members will not:

  • List, upload or post content or items in an inappropriate category;
  • Sell any counterfeit items or otherwise infringe the copyright, trade mark or other rights of third parties;
  • Fail to deliver item/payment for items purchased or sold, unless the seller has materially changed the item's description after you bid or the buyer fails to meet the posted terms;
  • Distribute or post spam, chain letters, or pyramid schemes;
  • Distribute viruses or any other technologies that may harm electricalstock.com, or the interests or property of electricalstock.com users;
  • Distribute, copy or modify content from electricalstock.com copyrights and trademarks from the electricalstock.com site;
  • Collect information about users.

If you are registering with electricalstock.com as a business, you must represent that you have the authority to legally bind that entity. If you are trading as a business on electricalstock.com, you must comply with all applicable laws relating to online trading.

You will not be able to cancel this Agreement under the Consumer Protection (Distance Selling) Regulations 2000 (or any equivalent legislation in your jurisdiction) once the supply of the services has commenced.

Using Information from electricalstock.com users

Our site and services allows users to receive information on a personal and financial basis to ensure that transactions are completed. They may gain access to see each other's name, user ID, email address, and other contact information, postal information and financial details. We cannot guarantee that other users will respect your privacy so we ask you to respect other users' privacy.

You agree to use user information only in accordance with applicable laws and regulations (including, without limitation, data protection laws) and only for electricalstock.com.

Fees

electricalstock.com is free to join and bidding is free. Fees are applicable for listing items and items that have sold.

All fees are quoted and charged in GBP sterling. You are responsible for paying all your fees and taxes applicable with using our sites and services in a timely manner with a valid payment method. You agree that we may issue you with invoices in electronic format by email.

Liability

Nothing in this Agreement shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees or for any other liability that cannot be limited or excluded by law.

electricalstock.com will not be held responsible for any loss you may incur as a result of electricalstock.com's other users' actions or inactions, including things they post. You acknowledge that we are not a traditional auctioneer. Instead, our sites are a venue to allow anyone to offer, sell, and buy just about anything electrical, at anytime, from anywhere, in a variety of pricing formats and venues.

electricalstock.com have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of listings, the truth or accuracy of feedback or other content posted by users on our sites. We do not review users’ listings or content and are not involved in the actual transaction between buyers and sellers.

You must accept sole responsibility for the legality of your own actions under laws applying to you and the legality of any items you have listed on electricalstock.com.

Although we use techniques that aim to verify the accuracy and truth of the information provided by our users, user verification on the internet is difficult. electricalstock.com cannot and does not confirm, and is not responsible for ensuring, the accuracy or truthfulness of users' purported identities or the validity of the information which they provide to us or post on our sites.

Returns Policy

All sellers must comply with the regulations of the distance selling act 2000.

The Distance Selling Regulations apply to both goods and services, where the contract is made without any face-to-face contact between supplier and consumer.

The Office of Fair Trading, Trading Standard Departments of local authorities in England, Scotland and Wales (www.tradingstandards.gov.uk) and the Department of Enterprise, Trade & Investment in Northern Ireland (www.detini.gov.uk) are the designated enforcement authorities for these Regulations.

The main provisions of the Regulations are that:

  • Consumers must be given clear information about the goods or services before buying;
  • Goods must be delivered within thirty days unless agreed otherwise;
  • Consumers have a cooling off period in which they can withdraw from the contract for any reason. The cooling off period begins as soon as the order has been made. In the case of goods, it ends seven working days after the day of receipt of the goods;
  • Where consumers notify the supplier in writing or another durable medium that they wish to cancel the contract, they must be refunded within 30 days all money paid.

Compensation

You agree that you will only use our site accordance with our guidelines and this Agreement. You will compensate us in full for any loss or costs, including reasonable legal fees, we incur arising out of any breach by you of our guidelines and this Agreement or your violation of any law or the rights of a third party.

Resolution of disputes

If a dispute arises between you and electricalstock.com, we strongly recommend you to contact us directly at electricalstock.com Ltd 6 Silverdale Drive, Guiseley, Leeds, LS20 8BE to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation. This Agreement shall be governed and construed in all respects by the laws of England and Wales. You and electricalstock.com both agree to submit to the exclusive jurisdiction of the English Courts; for claims falling within the jurisdiction of a County Court, you and electricalstock.com both agree to submit to the jurisdiction of the County Court of Wandsworth.

General

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Section headings are for reference purposes only and do not limit the scope or extent of such section.

Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.

We may amend this Agreement at any time by email or by posting the amended terms on this site. Except as stated elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted. This Agreement may not be otherwise amended except in a writing signed by you and us.

This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
